PART I — TERMS AND CONDITIONS OF SALE FOR TRAINING
Article 1 – Purpose
Beauty By Emma offers professional training in lash and brow beauty, including eyelash extensions and brow lamination.
These terms set out the conditions for registering, paying for and attending the courses offered by Beauty By Emma.
Details of each course — syllabus, objectives, duration, prerequisites, dates, times, location, price, teaching methods and any equipment provided — are given in the course description and/or the training contract or agreement.
Article 2 – Registration
Anyone applying to register must read these terms.
Registration becomes final once the formalities required by Beauty By Emma have been completed, subject to the specific rules applicable to the chosen funding method.
Trainees agree to provide accurate and complete information when registering.
Where a course has prerequisites, Beauty By Emma may check that they are met before confirming registration.
Article 3 – Fees
The applicable prices are those communicated to the trainee at the time of registration.
Fees are expressed in euros and are stated [including VAT / VAT not applicable depending on your situation].
Depending on the course chosen, the fee may include:
– training and learning support;
– course materials;
– equipment used during the course;
– a training kit, where expressly stated.
Personal travel, meal and accommodation expenses remain the trainee’s responsibility unless otherwise stated.
Article 4 – Payment terms
Payment terms depend on the course and the chosen funding method.
They are communicated before registration and specified, when necessary, in the training contract or agreement.
Beauty By Emma may offer different payment methods depending on the options available at the time of registration.
Article 5 – CPF and other funding
Some Beauty By Emma courses may be available through the Compte Personnel de Formation (CPF), France’s personal training account scheme, or other funding methods, subject to eligibility and the conditions in force at the time of registration.
Where a course is funded through CPF, the terms of the official Mon Compte Formation platform and the regulations in force apply.
The availability of a funding option does not guarantee that funding will be approved.
Trainees remain responsible for completing the necessary steps and providing the information required for their application.
Article 6 – Training funded personally by the trainee
Where an individual undertakes training independently and at their own expense, a vocational training contract is concluded in accordance with the applicable provisions of the French Labour Code.
The trainee has a withdrawal period of 10 days from signing the contract. The French Labour Code provides that no payment may be required before this period expires. After it expires, the initial payment must not exceed 30 % of the agreed price, and the remaining balance must be paid in instalments as the course progresses. Légifrance
The specific terms are indicated in the training contract.
Article 7 – Cancellation or postponement by the trainee
Any request to cancel or postpone must be sent to Beauty By Emma in writing as soon as possible.
The financial consequences of late cancellation, withdrawal from a course or absence are specified in the relevant training contract or agreement, subject to applicable laws and regulations and the rules of the funding scheme concerned.
Where a trainee who has entered into an individual, self-funded training contract cannot continue the course because of a duly recognised event of force majeure, only the training actually delivered is payable, in proportion to its value under the contract. Légifrance
Article 8 – Cancellation or postponement by Beauty By Emma
Beauty By Emma may have to postpone or cancel a training session, particularly in the event of force majeure, exceptional trainer unavailability or where the conditions needed for the course to run properly are not met.
The trainees concerned will be informed as soon as possible.
A new date may be proposed.
If a course is definitively cancelled for reasons attributable to Beauty By Emma, amounts relating to training not delivered will be refunded, unless the trainee accepts another date or the funding scheme has specific rules.
Article 9 – Late arrival and absence
Trainees agree to follow the stated timetable.
Any late arrival or absence must be reported to Beauty By Emma as soon as possible.
If a significant late arrival prevents normal participation in the course, Beauty By Emma may take the steps needed to ensure the session runs properly, in accordance with the applicable contract and internal rules.
Article 10 – Conduct of training courses
Trainees agree to behave respectfully towards the trainer, other trainees, models and anyone else present.
They also agree to follow the hygiene and safety rules and technical instructions provided by Beauty By Emma.
Equipment provided must be used carefully and for its intended purpose.
Article 11 – Models
Where a course requires practice on a model, the arrangements for the model’s attendance are provided before the course.
Trainees must follow the hygiene and safety rules and the protocols taught by Beauty By Emma.
Article 12 – Course materials and intellectual property
Course materials, documents, methods, photographs, videos and other content supplied to trainees remain protected by applicable intellectual property rights.
They are supplied for trainees’ personal use as part of their course.
Without prior written permission from Beauty By Emma, they may not, in particular, be reproduced in full, resold, distributed or used to create or deliver competing training.
Article 13 – Results
Beauty By Emma undertakes to provide the teaching resources specified to help trainees acquire the knowledge and techniques covered by the course.
The course does not, however, guarantee commercial success, revenue, clients or professional results.
Results depend in particular on the trainee’s practice, commitment and individual work.

Article 5 – Orders
Customers select the products they want and add them to their cart.
Before confirming an order, customers must check the selected products, quantities, total price and delivery details.
An order becomes binding once it has been confirmed and payment approved, subject to the provisions on the right of withdrawal.
French regulations require B2C e-commerce websites to provide pre-contractual information, including the price, delivery arrangements and the consumer’s right of withdrawal. economie.gouv.fr
An order confirmation is sent to the email address provided by the customer.
Article 6 – Payment

The relevant payment provider’s terms also apply when customers use its service.
Article 7 – Payment security

Beauty By Emma never asks customers to send their full banking details by email.
If payment is declined by the bank or relevant provider, the order may not be confirmed.
Article 8 – Delivery

Beauty By Emma cannot be held responsible for a delivery delay or failure directly caused by an incorrect or incomplete address supplied by the customer, subject to mandatory legal provisions.
Article 9 – Delivery costs
Delivery charges are calculated according to the chosen destination and delivery method, then displayed before the order is confirmed.
Any exclusions or special conditions are shown before the order is confirmed.
Article 10 – Shop collection

The order number and, if necessary, identification may be requested on collection.
Collection times and the exact address are provided when the order is placed or confirmed.
Article 11 – Receiving and checking an order
On receipt, customers are asked to check the condition of the parcel and the products received.
If a product is missing, damaged or different from the one ordered, customers are asked to contact Beauty By Emma promptly, quoting their order number and, where helpful, providing photographs showing the problem.
This procedure does not prevent consumers from exercising their statutory rights.
Store returns and exchanges policy
Returns and exchanges under the shop’s policy may be requested within 14 days of receipt for new, unused products. Return costs are paid by the customer, except where Beauty By Emma has made an error, the product is defective or the law requires otherwise. No restocking fee is charged. These shop policy terms do not limit the statutory right of withdrawal or the statutory guarantees described below.
Article 12 – Right of withdrawal
Under the rules applicable to distance contracts, consumers generally have 14 days from receiving the goods to exercise their right of withdrawal without having to give a reason. economie.gouv.fr
Consumers may exercise this right using the withdrawal form available separately on the Beauty By Emma website or by any unambiguous statement expressing their decision to withdraw.
Simply returning a product without a statement of withdrawal is not sufficient on its own. economie.gouv.fr
After notifying their decision, consumers must return the products within the applicable statutory period. The French Ministry of the Economy currently states that products must be returned no later than 14 days after the withdrawal notice is sent. economie.gouv.fr
Article 13 – Return costs
Unless Beauty By Emma has made an error, the product is defective or the law requires otherwise, consumers bear the direct costs of returning goods under the right of withdrawal, provided they were informed of this in advance. economie.gouv.fr
Products must be packaged appropriately to prevent damage during return transport.
Article 14 – Exceptions to the right of withdrawal
The right of withdrawal does not apply where a product falls within a statutory exception.
This may include certain goods made to the consumer’s specifications or clearly personalised, as well as certain goods unsealed after delivery that cannot be returned for hygiene or health-protection reasons, where the legal conditions for the exception are met.
Where a product sold by Beauty By Emma is excluded from the right of withdrawal, consumers must be informed before ordering.
Article 15 – Refund after withdrawal
Where consumers validly exercise their right of withdrawal, Beauty By Emma refunds the amounts due in accordance with applicable law.
The refund must be made no later than 14 days after the seller is informed of the decision to withdraw, subject to the statutory grounds for withholding a refund on goods. Refunds are generally made using the same payment method as the purchase, unless the consumer agrees to another method that incurs no fees. economie.gouv.fr
Article 16 – Statutory guarantees
Consumers benefit from the statutory guarantees applicable to purchased products, including the statutory guarantee of conformity and the guarantee against hidden defects, where the relevant conditions are met.
These guarantees apply independently of any commercial warranty offered by Beauty By Emma.
Article 17 – Products for professional use
Some products sold by Beauty By Emma are intended for beauty professionals, particularly eyelash extension technicians.
Customers must follow the directions, precautions, hygiene rules, storage conditions and contraindications stated on the products, packaging or instructions.
Some products require specific professional skills and must be used for their intended purpose.
Beauty By Emma cannot be held responsible for consequences of use that clearly fails to follow the instructions or the product’s intended purpose, without affecting any liability that the seller cannot legally exclude.
Article 18 – Liability
Beauty By Emma is responsible for fulfilling its obligations in accordance with applicable law.
No provision of these Terms and Conditions of Sale (CGV) may remove or limit the mandatory rights granted to consumers by law.
